Understanding Your Rights and Options in South Africa

Evictions

01

What is Evictions?

An eviction is the lawful removal of a tenant from a rental property. It’s a stressful situation for both landlords and tenants. South African law protects the rights of both parties, outlining a specific legal process for evictions.

02

South African Law and Evictions

The Prevention of Illegal Eviction from and Unlawful Occupation of Property Act (PIE Act) governs evictions in South Africa. This act protects tenants from unlawful eviction and ensures a fair and legal process for repossessing a property by landlords. Landlords must have a valid reason for eviction and follow the legal procedures outlined in the PIE Act.

03

The Process of evictions

The eviction process typically involves these steps:

  1. Notice to Vacate: The landlord serves the tenant with a written notice, specifying the reason for eviction and the date by which the tenant must vacate the property.
  2. Dispute Resolution (Optional): If the tenant disputes the eviction, they may attempt to resolve the issue with the landlord through negotiation or mediation.
  3. Court Application: If no resolution is reached, the landlord applies to the magistrate’s court for an eviction order.
  4. Court Hearing: Both parties present their arguments to the court. The court will issue an eviction order if the landlord has a valid reason and followed the proper procedures.
  5. Execution of the Order: If the tenant does not vacate after the eviction order is granted, the sheriff may be called upon to remove the tenant and their belongings from the property.
